Can you help your worker get papers?
We continue to answer your questions about immigration law in the United States.
Lorenzo from South Carolina wanted to know if his employer can petition for him since he likes him as a worker. And Lorenzo further tells us that he is a construction worker and his employer is very interested in keeping him working for him legally. Is that possible?
So if you're an employer and you have an employee who does not have legal status here in the United States listen up. Are you able to petition for them? First and foremost, talk to an immigration lawyer who works on work visas because we're going to know and we're going to be able to analyze the case. Second, if your employee is already in an unlawful status, we are not going to be able to get that work visa. One of our requirements for all the work visas is that the potential employee is in the United States in a lawful status or is outside of the United States. But please, talk to an immigration lawyer to see if there is any way that they can help your employee. Now you know.
