Handling a Notice of Intent to Deny (NOID)

It is an especially alarming event to receive a Notice of Intent to Deny (NOID) when applying for a visa or permanent residence.  If you happen to be an employee waiting for a pending employment-based immigrant or nonimmigrant visa, it may feel like your opportunity will slip away.  As an employer, if you receive a NOID on a petition filed for a potential employee, you may be wondering if you will have to begin the search for a suitable employee all over again.  


It is important to note, however, that receiving a NOID does not necessarily mean that your petition for the visa petition is hopeless. It is possible to respond successfully to a Notice of Intent to Deny and to ultimately receive the visa that the applicant is seeking.
